The Concept of Real Estate in Russian Federation Legislation

The purpose of this work is to identify and analyze the features of the concept of real estate, to conduct a comparative study of the concept of real estate, as well as ways to register rights to it in the Russian Federation and some foreign countries, and to determine the specifics of the acquisition of ownership of real estate. In accordance with the above-mentioned goals, I set following objectives in this paper: -to formulate the concept of "real estate" on the basis of modern legislation, taking into account its origin and development in Russian and foreign law; ˗ to identify types of property that relate to real estate, as well as consider ownership of them; ˗Graduation qualification work consists of an introduction, three chapters, nine paragraphs, a conclusion and a bibliographic list. On the basis of the analysis, the following conclusions are formulated. First, the specific concept of real estate is not contained in the legislation of the Russian Federation, the legislator derives its definition through the enumeration of specific objects that relate to real estate. Secondly, from the definition given in the legislation, it can be concluded that objects are recognized by real estate on the basis of their natural properties, based on their inseparable connection with the earth's surface, and also on the basis of the legal criterion according to which an object is recognized as real estate by law. Thirdly, it is necessary to note the peculiarities of the property right in relation to real property, which is absolute, and it is also the most wide-ranging mechanism allowing an authorized person to fully influence the real estate object, namely, to own, use and dispose of it. And finally, fourth, the feature of real estate is the procedure of state registration of property rights for real estate, which is mandatory and serves as the only evidence of the ownership of the property to a specific person.
