The Nature of Regisration Record of Rights on Real Estate

This paper is devoted to the study of the correlation between possession and registration record in EGRN as methods of legitimation in relations with real estate. Some researchers consider that possession of real estate is limited to a record in EGRN certifying the existence of ownership rights to real estate. This legal concept is called "book possession" and is typical for German law jurisdictions. The purpose of this paper is to analyze the theory of "book possession" both from the standpoint of its applicability to Russian law, and from the point of its practical expediency for the turnover of real estate.
