Implementation of the Unified Acts of EU Private International Law in the National Laws of European Countries (Germany, Austria, Switzerland)

This master dissertation is aimed at the unification of EU international private law and its interaction with the national laws of European countries (Germany, Austria, Switzerland). The master dissertation consists of an introduction, two chapters, three paragraphs, a conclusion and a bibliography. Chapter I elaborates the process of unification of EU international private law. Section I covers «unification of PIL» and «unification of EU PIL» definitions, its interaction. The stages of unification of EU international private law are considered in this section. Chapter II contains the process of unification of EU international private law and the interrelation of standardized norms with the national laws of European countries (Germany, Austria, Switzerland). Section I of this chapter covers analysis of the unification acts of EU international private law and national laws (Germany, Austria, Switzerland). Section II of this chapter covers prospects, problems and benefits of EU international private law unification. Based on this research the following conclusions were made: firstly, international private law unification is a process of uniform law creation in national legislations; secondly, unification is carried out in the EU; thirdly, Germany had incorporated the norms of EU Regulations in the main law on international private law; fourthly, PIL of Austia is related to EU Regulations and has included similar provisions in the main law; fifthly, international private law of Switzerland is unique, but its provisions are similar with the EU Regulations; sixthly, there are many unified recommendatory rules; seventhly, serious unification of EU international private law is possible in the absence of criticism and difficulties from the EU members.
