Actual Issues of Regulation the Work of Distant Employees: Theoretical and Practical Terms

The aims of paper include exploring main tendencies of remote work and identifying possible prospects for its further use in Russia, and strengthening the theoretical base through the development of a conceptual framework and identification of the future characteristics of the remote work which does not involve presence at the office during the work day. To achieve the goals there are the following objectives: a) to define the concept of the remote workplace; b) to consider the variability of labor law relations of remote workers, depending on the scope of their activities; c) to identify the characteristics of an attraction to a disciplinary responsibility of remote workers. The paper consists of introduction, three chapters, conclusion and list of references. The first Chapter is devoted to the definition of ‘distant employee’ and scientific origins of this concept and its historical genesis and legal evolution. In the second Chapter the author considers the questions of variability of labor law relations of distance work in journalism and graphic design. In the third Chapter the author analyzes an attraction to a disciplinary responsibility of the remote workers. Basing on the analysis, there are the following conclusions: Firstly, the remote work differs from the office work due to such features as the form of home amenities, free schedule, and the employee has an opportunity to plan the routine of one’s working day. Secondly, the other aspect is the psychological one. For most people it is much easier and more comfortable to work at home, without superiors’ control over the working process, without chatting with other employees. The third reason is a real need of the remote work in some spheres.
