The Implementation of the Principle of Sepatation of Powers in Subjects of the Russian Federation in the North Caucasian Federal District

The principle of Separation of Powers division of the authorities – the fundamental principle of the organization of the government in the democratic, constitutional state. According to him, the government divided into legislative, executive and judicial branches. Subjects of the Russian Federation in the North Caucasian Federal District have enshrined this principle in the basic laws. Research objective is the analysis of the principle of division of the authorities, creation of public authorities in subjects of the Russian Federation in the North Caucasian Federal District on its basis, and realization of system of controls and counterbalances in relationship between bodies of legislative and executive power of subjects of the Russian Federation. According to the conducted research, the author has drawn the following conclusions: 1) the model of the power enshrined in the federal legislation doesn't allow territorial subjects of the Russian Federation to create system of public authorities taking into account the features inherent in each subject. Unification which was generated by the federal legislation doesn't consider a variety of the Russian regions and doesn't promote their development at all. 2) For development of territorial subjects of the Russian Federation as independent state and legal educations establishment of parliamentary model which will lead to development of party life in subjects is necessary, will gradually destroy clan system and will promote formation in consciousness of society of "parliamentary culture", i.e. to judgment by the people of as only source of the power in the country. 3) The system of controls and counterbalances in territorial subjects of the Russian Federation is deprived of independence, in connection with intervention in her of the federal level of the power.
