Problems of Free Use of Creations

Nowadays the number of consumers of intellectual property objects grows steeply, in this connection there is a need of detailed and fullest settlement in legislation of ways of their free use, which do not require the author's consent and respect his rights. This paper is devoted to a research of the most problematic issues in the sphere of free use of creations. Particular attention is paid to the 3 gaps in this sphere of legal regulation such as free use of works by special subjects (libraries and organizations of broadcasting); free use of the works which turned into public property and free use of the works placed on the Internet. The author investigates different solutions of these problematic issues and offers final recommendations to the legislator for an improvement these legal relationships.
