Guarantee of Realizing Constitutional Right of Citizens on Entrepreneurial Activity in the Russian Federation

Currently, under the conditions of market economy and unstable economic situation, the priority aim of the state is the development of entrepreneurial activity. In the framework of this survey, the content of the citizens' right to entrepreneurial activity is analyzed, as well as the systematization of guarantees for the implementation of this right in the Russian Federation. The article addresses the issue of correlation to limits and restrictions rights to entrepreneurial activity; the approaches of authoritative scientists, as well as the practice of the Constitutional court are applied. The author submits the own definition and classification of the guarantees and tenders an offer the jurisdictional mechanisms for protecting the right to entrepreneurial activity as indispensable element of guarantees in the conditions of encroachment of this right by other entities. A special attention is paid to right to resort to right to appeal to executive branch authorities and judicial protection as a fundamental guarantee of the realization of the constitutional right to entrepreneurial activity.
