Legal Nature of Abuse Procedural Rights in Civil Proceedings.

This work is devoted to the abuse of procedural rights. The study illustrates that the problem of abuse of procedural rights is a negative phenomenon, which has a negative impact on the development of civil proceedings. There are mechanisms to counter the abuse of procedural rights in the procedure legislation, however, today the issue of the need for optimization of legal norms is acute to achieve effective regulation of procedural relations. In work on the basis of an analysis of doctrinal positions and the rules of law, studied the nature of abuse of procedural rights, viewed its relationship with the principles of civil procedure, learned the main features and measures to counteract procedural abuses. Specific methods of prevention are proposed, suppression and measures of responsibility for the abuse of procedural rights.
