Protection of the Exclusive Right of Patent Holders

In the current master's thesis, based on foreign experience and current problems existing in domestic patent law, an effective mechanism for protecting the exclusive right of the patent holder was developed, which does not violate the balance of private and public interests applicable to patent relations in the Russian Federation. The author of this work has developed an effective legal filter for identifying and suppressing the strategies aimed at obtaining unfair advantages and benefits of strategies of other rightholders. The paper substantiates the practical significance of the possibility of filing a counterclaim on the recognition of a patent as invalid, without suspending or postponing proceedings in a case of violation of the exclusive right to a disputable object of intellectual property.
