Invalidity of Transaction Contradicting Fundamentals of the Public Order or Morality

The dissertation is devoted to the study of the invalidity of transaction contradicting fundamentals of the public order or morality in virtue of article 169 of the Civil code of the Russian Federation. The dissertation is considered the problem of uncertainty of such legal categories as fundamentals of the “public order” or “morality”, the various points of view of scientists, endurances from judicial certificates concerning essence of bases of the law and order and morals, own conclusions on this issue, positions on improvement of article 169 of the Civil code of the Russian Federation are resulted. At the same time, the legal implications of transaction concluded for a purpose that is contrary to the fundamentals of the public order or morality are invalid and the conclusions are drawn about exclusion of the confiscation implications from article 169 of the Civil Code of the Russian Federation. Key words: public order, morality, invalidity, confiscation.
