Data Broker as a New Subject of Cyber Law in the Era of Big Data

The aim of this research is to determine the legal status of the data broker as a new subject of law, to analyze the existing regulation in this area, to identify problems and formulate theoretical and practical proposals for improving legislation. The definition of profiling developed in legislation and doctrine is given, positive and negative sides of profiling are revealed. The legal status of the data broker in the context of civil law is analyzed, namely the qualification of data broker companies as a commercial or non-commercial legal entity, the issue of regulation through licensing or through mandatory membership in self-regulatory organizations is considered. The nature of contracts on the transfer of personal data used by data brokers in their activities is considered. The issue of data broker status in the context of information law is analyzed. In conclusion of the research threats to the fundamental rights and freedoms of citizens arising in connection with the activities of data brokers are revealed and some recommendations for risks minimization are provided.
