Marriage Contract in Russian Family Law

This graduate paper is aimed to hold an analysis of the institute of marriage contract in Russian Family law. The main objectives that allow us to obtain the aim of the investigation are а) overlooking the contract’s historical development; b) examination of its legal nature and doctrinal sources concerning this legal phenomenon; (c)defining its subjects; d) analysis of the legal rules that regulate the contract’s conclusion, changing its provisions and its probable cancellation; e)comparison of this institute with the one in some foreign legislations; e) studying of the materials of the legal practice concerning the contract’s regulation. Basing on the conducted research, several conclusions were made. Firstly, nowadays marriage contract is a common and effective way of regulating spouses’ property relations that has an interesting history. Its existence date back to Ancient Russia times. It has had a long historical way that was strongly influenced by the discussion about its legal nature that is is still difficult to define. Secondly, it is necessary to mention, that the contract is to be concluded by certain subjects and has strict delimitations in accordance with its form and content, for example, regulation of non-property relations by the contract is forbidden. Thirdly, marriage contract is not static, it could be changed or be proved invalid. This possibility is a guarantee of the rights of spouses and third parties.
