The quality of providing qualified legal assistance guaranteed by the Constitution of the Russian Federation allows us to make a conclusions about the development of the constitutional state and legal culture in the society. Under the laws of a market economy the quality of qualified legal assistance and its cost are closely connected, thus, by identifying existing problems of payment for qualified legal assistance, it's possible to identify more important and endemic problems of that issue and analyze the potential for its development. The purpose of this research was a complex analysis of the most problematic theoretical and practical aspects of the legal institution of payment for qualified legal assistance. The special attention was given to current notion of the qualified legal assistance and the subjects of its provision, potential for pro bono development in the Russian legal services market, searching for important problems of unpaid (subsidiary) qualified legal assistance and its possibility and also searching for problems dealing with payment for qualified legal assistance provided by judicial representatives.
