Legal Regulation of Means of Protection of Copyright and Related Rights

This work is devoted to the existing legal regulation of technological protection measures of copyright and related rights in the Russian Federation. The paper deals with the notion of technological protection measures (hereinafter referred to as " TPMs"), which is stated in the Civil Code of the Russian Federation, as well as their key characteristics and the classification of the types of the TPMs. In addition, the paper analyzes the legal nature of the TPMs and the rights to use the TPMs in terms of the current Russian legislation. The study presents the conditions for the effectiveness of the use of of technological protection measures as a way to protect copyright and related rights in the digital era. The comparison of the TPMs with the norms of law and contractual constructions as ways of protecting the rights of the author is also made. The study also contains an analysis of the limitations of the application of TPMs by the right holder in the context of fair use doctrine and the rights of consumers.
