Indemnification of Contract Damages in Arbitration Practice

Todua Guram Georgievich, stuodent of National research University "The higher school of economics" This work, researches the problems associated with indemnification of contract damages in arbitration practice. The work analyzes the norms of Russian foreign and international law. This work is devoted to unfold most of actual issues of this institution Most of the work is devoted to the analysis of the institution of indemnification for damages. The paper demonstrates the difficulties of proving the amount of losses. The principles of limitation of liability are analyzed. Such as, the criterion of foreseeability of damages, mitigation. Another part of the work is devoted to the analysis of a concrete and abstract method of assessing contract damages. The work analyzes the historical causes of occurrence. Author suggests the Changes are proposed to improve Russian legislation. Key words: Damages, foreseeability of damages, mitigation, abstract and concrete methods of assessing contract damages
