Protection of commercial confidentiality in labor relations

Nowadays the problem of protection of commercial confidentiality in labor relationship is very actual. In his thesis the author explores the concept of commercial confidentiality and confidential information, examines the historical formation and development of Institute of a commercial confidentiality, explores the procedure of protection of commercial confidentiality and liability for its disclosure in accordance with the current Russian legislation, analyzes the most striking examples of court practice on the problematic issues and also explores the possibility of application in Russia of widely spread in the practice of foreign legislation non-compete agreements concluded between employee and employer, as a way to protect the employer from the unlawful disclosure of commercial confidentiality. As the result of this work the author proposes to modernize current legislation by making amendments to the Law "On commercial confidentiality" and to the Labour code of the Russian Federation.
