Termination of Exclusive Right

The relevance and practical significance of the topic on termination of the exclusive right is becoming obvious with the fact that the exclusive right nowadays is a significant asset, which can be possessed by the party of the civil transaction. There is a clear tendency in the Russian legislation towards the unification of the norms on intellectual property, including the systematization regarding the statics and the dynamics of relations in this sphere. Streamlining the grounds that terminate the exclusive right will ensure stability and consistency of legislation in the field of intellectual property, reduce the number of disputes and, as a result, accelerate turnover. The problem of this topic, first of all, is connected with finding the balance of private and public interests. In this work, in addition to the concept and content of the exclusive right, which is the starting point in the study of any institution of law, the grounds for the termination of the exclusive right will be considered. These ground can be aimed, on the one hand, on the protection of public interest, and on the other hand, to ensure freedom Right holder. From the limitation of the monopoly of the right holder and the suppression of various kinds of abuses, to the possibility for the right holder to disclose his entrepreneurial potential, the termination of the exclusive faces with all of mentioned issues.
