Commercial rights in sport

Dissertational research rises the problem of effective regulation and protection of commercial rights in sport. The work is based on the analysis of cases considering the rights to organize competitions, as well as legal and corporate regulations of the competitions broadcasting. In particular, such questions as jurisdiction of sport federations and professional leagues in terms of holding competitions, and owing and implementing of broadcasting rights are discussed. Also the dissertation shows the main characteristics of the broadcasting right, which is the basis for conclusion about its specifics. Distinctions between the right to broadcast a competition and the right to organize on-air and cable broadcasting are emphasized. The thesis about belonging of the main scope of the commercial rights for competitions to their organizers is one of the main results of the research. The analysis of the monopoly for competitions, established by the international sports federations and its action in certain regions and countries is given in the work. A lot of attention is given to foreign experience with the example of the European Union and the United States of America. It is noted that the rights for the organization and holding the professional competitions in Russia, that uses state support, belong to the all-Russian sport federations. This fact is the reason of foundation of the institute of delegation of the rights for competitions to professional leagues. Within the analysis the rights for broadcasting the following conclusions are drawn: the civil nature of the right, uniqueness of a competition as complicated phenomenon, the largest economic weight of competence of rights disposal. The conclusion, that the right of exclusive use of place for holding competitions that belongs to organizer is the basis of rights of competitions enlightening in general, is drawn.
