Selected Issues of Reforming the Legislation of Real Right of the Russian Federation

The paper discusses certain issues of the content of provisions of civil legislation of the Russian Federation in the part of rights in rem. The author explores the General theoretical provisions on proprietary right, from the point of view of its definition, signs and contents. Deals with the category of possession as dualistic legal phenomena acting simultaneously special the actual condition and real right. Examines specific types of rights contained in the existing civil legislation and the text of the bill reforms - the right to use-possession, security of property rights property rights benefits. According to the study the author makes a conclusion about impossibility of allocation of a number of rights assigned by the legislator to number of things, among these because of their fundamental contradictions theoretical constructs of property law. Also, the author made a number of suggestions on improving the draft reform of the civil legislation of the Russian Federation on property law.
