Derivative Works as Objects of Copyright

The present research is devoted to the study of derivative works as objects of copyright. The special nature of derivative work requires a balance of interests between the author of pre-existing and derivative works. However the lack of clarity in the legislation leads to violations of the author’s rights and unreasonable restrictions of derivative works authors. The paper includes the study of legislation, court practice and doctrine in the field of derivative works and proposals for improving legislation. The doctrinal criteria of derivative works are analyzed in the present research. In addition, the nature of adaptation is determined and the procedure for transferring the right to processing is considered. The last chapter contains the study of modification of computer programs.
