State Registration of Real Estate: Actual Problems of Legal Regulation

The present research is devoted to legal analysis of institute of state registration of real estate. The work contains consideration of doctrinal concepts correlated with examination of legal acts and judicial practice. Under the state registration of real estate legislator undertakes the legal act of recognition and confirmation by the state of occurrence, limitation (encumbrance), transfer and termination of rights to immovable property. The research concentrates on the performance of the two systems state registration: the Torrens system and the recording system, the problematic aspects of state registration in Russia, as well as the study of the reform of the institution of state registration. According to the complex analysis of state registration, it was concluded that the best registration system and solutions to problems.
