The Practice of Buying Construction Works of High Costs

This academic paper is devoted to the study of modern Russian practice of public procurement of construction and installation works. The author reviewed all the key definitions used in the process of purchasing services belonging to this category, specifying the specifics of the procedure for their procurement, many of which go beyond the 44-FZ "On the contract system" and find their foundation in the Urban Planning and Civil Codes of the Russian Federation. Further, the author in the work indicated what constitutes purchases of high-value construction services, by what methods the initial maximum price of contracts for their provision is formed, and what is the role of design estimates in pricing. Summing up, the author of the research in the final part of the work recommended to use only the price criterion in the process of determining the contractor only for the purchase of standardized goods or services, which are not construction and installation works of high cost. Thus, the method of electronic auction for this category of purchases can be acceptable only in conditions of short deadlines. When the object of procurement is complex and technically complex, when its quality characteristics change depending on the conditions, and failure to perform or improper implementation of the contract may entail detailed consequences, the most rational application is the aggregate criteria on the basis of which the winner is determined. This kind of opportunity is provided through an open tender. The study successfully confirms and underscores its unpopularity, and as a result, the undervaluation on the part of the customers of the Moscow region.
