Challenging Transactions of a Citizen under Insolvency (Bankruptcy) in Accordance with the Legislation of the Russian Federation

In the Russian legislation was introduced a new institution of insolvency (bankruptcy) of individuals. Despite the fact that the institution of bankruptcy has long functioned in the Russian legal system, before that, citizens could not be declared bankrupt. With the introduction of these legislative changes, it became possible to challenge transactions of citizens within the insolvency (bankruptcy) procedure, both on special and general grounds. From the application of these grounds, the principles of restitution for disputed transactions for citizens also change. Despite the development of practice of challenging transactions of legal entities, it can not be said that this experience is fully applicable to disputing transactions of individuals. Given that the challenge of transactions of individuals in the insolvency (bankruptcy) procedure has its own specifics, there is a need for careful analysis and analysis of this material, which is given in this work, taking into account the experience gained in dealing with legal entities and the emerging jurisprudence on individuals.
