Special Grounds for Invalidating the Debtor’s Transactions under Insolvency (Bankruptcy)

Graduation qualification work is devoted to the investigation of the legal institution of invalidating the debtor's transactions on special grounds in case of insolvency (bankruptcy). In the course of the research, the institution of challenging the debtor's transactions in insolvency in Germany and Russia was analyzed. Particular attention was paid to issues of invalidating the debtor's transactions on special grounds in case of insolvency in Russia. Within the framework of this graduation qualification work, legal norms regulating the issues of challenging the debtor's transactions in insolvency (bankruptcy), arbitration-legal practice and explanations of higher courts are analyzed; the legal norms governing the contesting of the debtor's transactions in insolvency (bankruptcy) in Russia and Germany are compared. The conclusions and practical recommendations formulated in the work can be taken into account when improving the Federal Law on insolvency (bankruptcy), as well as in law enforcement practice.
