Сhallenging the Debtor's Transactions

This master's thesis is devoted to problematic issues with the sphere of challenging the debtor's transactions. The purpose of the research is to identify and formulate the qualifying signs of legal facts that can be challenged on bankrupt grounds, to identify the criterion for distinguishing disputable and insignificant transactions of the debtor, and to establish the specifics of the occurrence of legal consequences of the invalid transaction of the debtor. To achieve this goal, the analysis of the institution of competitive contesting of the debtor's transactions in the Russian legal system was conducted, a correlation of the concepts "civil legal transaction" and "debtor's transaction" was established within the framework of the Bankruptcy Law, general and special grounds for challenging the debtor's transactions were revealed, and The peculiarities of the legal consequences of the invalid debtor's transaction are also examined.
