Procedural Features of Disputes Resolution on Protection of Intellectual Property Rights

The main purpose of this diploma project is a comprehensive identification of procedural features of disputes resolution on protection of intellectual property rights to optimize the legal regulation of this area. The aim is to determine the characteristics of jurisdiction of disputes on the protection of intellectual property rights; study of persons involved in cases of this kind; study the specific features in the application of interim measures and in the process of proof; study the history and functioning of the Court of intellectual property rights and features of the proceedings in it. In this final qualification work the relationship between administrative and judicial forms of protection of intellectual property rights is described, as well as the conclusions about the problems of coexistence of both forms are made; the individuals involved in the case as plaintiffs and defendants are described; conducting an examination and the involvement of the expert are analyzed; the features of the types of interim measures in cases concerning the protection of intellectual property rights are described; the difficulties in determining the competence of the Court of intellectual property rights are stated and etc. Also, in this diploma project some proposals aimed at improving the existing procedural legislation are developed.
