Work of Human Rights Commissioner for the Russian Federation in the Protection Mechanism of Rights to Religion

This work is based on consideration of the relationship of two legal phenomena: the right to freedom of conscience and freedom of religion and the Commissioner for Human Rights in the Russian Federation. Purpose is to study the activities of the Commissioner for Human Rights in the Russian Federation in the mechanism for protecting the rights to freedom of conscience and freedom of religion. Methods are historical; comparative; formal legal; system analysis. In the modern world, the state undertakes to ensure the conditions for the realais of freedom of conscience and freedom of religion in conflict-free form and, if necessary, protection. During the analysis of legal bases of activity, the Commissioner for Human Rights in the Russian Federation we were revealed a conflict between Part 1, Article 1 and Art. 15 "On the Commissioner for Human Rights in the Russian Federation". The purpose of institution of the institution The Commissioner for Human Rights in the Russian Federation (Part 1, Article 1) is presupposes the protection of rights and freedoms exclusively of citizens. However Art. 15 more fully regulates human rights activities, as they are subject to review of complaints, including from foreign citizens and stateless persons who are on the territory of Russia. We consider it possible to state part 1 of Art. 1 like that: "The position of the Commissioner for Human Rights in the Russian Federation is established in accordance with the Constitution of the Russian Federation in order to ensure the protection of human and citizen rights and freedoms, their observance and respect by state bodies, local governments and officials. "
