Appeals of Organizations to Public Authorities: Legal Regulation and Practice

The Institute of Appeals is one of the most significant foundations of the constitutional system, it is the only way of interaction, communication and representation of the applicants' interests. The Institute takes not only effective functions, but it can also influence decisions made by public authorities. Legal regulation of the institution of appeals related to their legal status. Therefore, the right to address organizations remains an extremely controversial and poorly regulated issue. The federal legislator does not understand the functions, goals of appeals, and this is expressed in the absence of a stable formed practice of appealing organizations. In this study, the subject composition, legal status, essence, history, practice of application in and outside of Russia was considered, the main types of organizations' appeals, formed in the modern period and their influence on legal relations with public authorities, were considered. The following analytical methods were used in the study; comparative, historical analysis of analytical statistical and other objective methods. Proceeding from the study, proposals were made to the federal legislator in the urgent change in the institution of appeals of organizations, which should be expressed in changes "appeals", change and introduction in the reverse order of the form and types of applications, while they should take into account the special status and structure of legal entities as applicants. In addition, it is necessary to additionally add the capabilities of organizations with legislative and legislative initiative, the possibility of handling notification of public events and other changes. This should play a role in the openness of the authorities and municipal authorities, as well as resolve the administrative barrier between entrepreneurs and public authorities.
