Educational Programme: Jurisprudence (Bachelor)

Year of Graduation: 2018

The paper is devoted to the study of the institution of the trust in terms of private international law. Structurally, the work is divided into 3 chapters, in which the author reviews consistently the historical prerequisites for the establishment of the institution of the trust, its perception by countries that historically do not belong to the Anglo-Saxon legal system, a comparative legal analysis of conflict regulation of certain aspects of trust relationships and modern trends in the harmonization of private international law in this domain. Based on the results of consideration of the above issues, the author formulated a number of conclusions indicating that the legal regulation of cross-border relations with the participation of the trust is still characterized by uncertainty due to the fact that there is no unified substantive understanding of this institution and worldwide unified conflict regulation in this sphere of law. When writing the work, domestic and foreign legal acts, monographs, articles, educational literature, as well as foreign jurisprudence were used.
