Directness and Orality as General Conditions of Criminal Proceedings

Directness and orality are the milestones of high importance, they ascertain the nature and meaning, the purpose of criminal proceedings. On one hand, they determine ability of criminal proceedings to be humane, conjunctive to common sense, to be accessible and understandable for everyone. On the other hand, they are necessary preconditions for administration of justice. This study reveals the theoretical content of directness and orality statements in criminal proceedings; their role in constitution of an effective judicial procedure is shown; the essence of directness and orality as of general conditions of judicial proceedings in the Russian legislation is specified; the main in-court violations of the theoretical model of directness and orality are divulged; the legal and social consequences of such violations are indicated.
