The Age as a Basis of Differentiation in Labor Law

ANNOTATION This final qualifying work is devoted to the study of the differentiation of the legal regulation of employees based on age. The special relevance of this problem is related to the general trends of population aging and the reduction of labor resources. The aim of the work is to study and identify a set of theoretical and practical problems associated with the implementation of subjective labor rights and legitimate interests of young workers and workers of older age groups. As part of the final qualification work, a study was conducted: - history of development and current state of legislation on the differentiation of the legal regulation of the worker's labor on the basis of age; - the content and key features of the labor legal status of these workers; - Foreign legal norms governing the work of workers of different age groups; The volume of the research is eighty pages. The thesis consists of an introduction, three chapters, a conclusion. The conducted research allowed to draw a number of conclusions concerning the problematic issues of the regulatory legal regulation of labor relations with employees of different age groups. First, there is no single term and clear criteria for the category "workers of older age groups" in legal science and Russian legislation, as well as a single interpretation of the concept of "youth" and clear age boundaries at the federal and regional levels. Secondly, the inconsistency of the reduced working hours for minors in relation to other categories of workers established by the legislation, which with a reduced working time, is paid full wages, is revealed. Thirdly, according to Article 3 of the Labor Code of the Russian Federation and international norms, the ability to enter into a fixed-term employment contract with pensioners by age restricts them to labor rights, distinguishing workers depending on their social status and age.
