Participation of a Lawyer in the Civil Process

This work is devoted to the problems of the lawyer's participation in the civil process. Such issues as the dominant role of the attorney in the process of formation of the legal position on the case, the priority of the law and morality over the will of the principal are considered in detail. Attention is paid to such practical issues as the remuneration of the lawyer in the form of a success fee, the possibility of including this amount in court costs, as well as the possibility of bringing the lawyer to liability for improper provision of services. The author also analyzes the prospects of introducing an attorney monopoly in Russia.
