Appeal Review in Civil Procedure

The purpose of the work is to identify the nature and characteristics of the appeal process. The main tasks of the work are: analyses of trends in the development of appellate proceedings, taking into account the established practice; study of the general powers of the court in the appellate instance; analysis of the reform of procedural law; the identification of the main problems of the appeal process and the search for possible solutions. The structure of the work consists of: the introduction, three chapters, in which six paragraphs are concentrated and the conclusion. The first chapter is about the study of the general provisions of the appeal, in which considered: history of occurrence of the appeal, its essence and significance for the judicial process, as well as a general description of the powers of the appellate court. In the second chapter focused aspects of the case by the appellate court, namely the procedure for submission and consideration of the appeal, the grounds for cancellation or change of the decision of the court of first instance, as well as the limits of the case by the appellate court. The last chapter of the final qualifying work contains information on the reform of procedural legislation in the field of appeal. Based on the conducted research, the conclusions were formulated: study in detail the nature of the appeals proceedings, especially in the civil process; to formulate the need for changes in the Code of Civil Procedure of the Russian Federation, for example, extending the powers of the court of appeal, giving him the opportunity to send the case for fresh consideration to the court of first instance; to identify the need for the unification of civil procedural legislation that will ensure a higher level of protection of the rights and legitimate interests of citizens, the need for a unified approach to legal regulation of the grounds for changing or repealing decisions by the appellate court in Russian procedural legislation.
