Alternative Dispute Resolution of Economical Cases

The graduation thesis is devoted to alternative methods of resolution of economical cases existing both in Russian and foreign jurisdictions. The main objectives of the thesis are set to be: 1) A thorough description of the existing methods of alternative dispute resolution of commercial conflicts; 2) An analysis of the legislation existing in this sphere; 3) A specification of the main advantages of alternative dispute resolution of economical cases; 4) A determination of the problems existing in the sphere of ADR and suggestion of possible ways of their solution. The graduation thesis consists of the introduction, three chapters, five paragraphs and the conclusion. The first chapter of the project describes the history of alternative dispute resolution and also its practice of use in foreign jurisdictions. The second part of the thesis is devoted to the analysis of existing methods of alternative dispute resolution of economical cases in the Russian Federation. The final chapter of the project concentrates on the determination of the main problem existing in the sphere of alternative dispute resolution and develops their possible ways of solution. The main conclusions on the basis of the thesis are: 1) The system of alternative dispute resolution of economical cases can be extremely effective and that fact is proven by the foreign experience of use of ADR of commercial conflicts; 2) In the Russian Federation methods of alternative dispute resolution of economical cases only start to develop and there are a lot of issues in this sphere due to the low quality of the legislation; 3) ADR of economical cases can be effective in Russia if the important measures will be taken which include the global reform of the legislation and increasing of popularity of ADR using different means of mass media.
