Procedural Peculiarities of Consideration of Antitrust Disputes

Nowadays antitrust disputes are one of the most complicated categories of the cases considered by Russian courts. This is primarily due to the fact that antitrust law has a broad economic basis in contradistinction to most other branches. There is a clear underestimation of the role and importance of this problem in the field of antitrust legislation and in arbitration preceding the modern legal literature. The achievement of these objectives made it necessary to solve the following theoretical and scientific-practical problems:1) Formulate the concept of dispute in the field of antitrust law and identify the categories of cases considered by the courts in this area;2) Determine the jurisdiction of disputes in the field of antitrust law and analyze the existing problems of jurisdiction of disputes in the field of antitrust law3) Describe the procedure in challenge of decisions, improvement notice, cautions of antitrust authorities and emerging problematic issues;4) analyze the important role of the application of economic analysis on the example of individual cases in the field of antitrust law;5) Analyze the institution of private- law claims in the field of antitrust law as an important way to defense of rights aimed at suppressing monopolistic activities and unfair competition.
