Standards of Proof: The Prospects for Implementation in the Russian Procedural Law

The main objective of the research is to study systematically the phenomenon of standards of proof and to evaluate the legal prospects for the implementation of this institution in Russian procedural legal system. The methodology of the research is based on the calculation of the philosophical and general scientific methods, including structural and functional research, methods of forecasting social processes, analysis and synthesis, induction and deduction, the method of historicism, combined with hermeneutics and phenomenology. The basic working hypothesis is based on the consideration that the implementation of the institute of standards of proof in the Russian procedural legislation will contribute to the improvement of procedural technologies and the coping of vices in the activities of the courts. Thus, the present study seems reasonable to be divided into two semantic blocks. The first part is a description of the construction of standards of proof in the Common Law. The second part is an identification of problems in Russian process and a foundation proposes solutions to the problems identified under the prism of the implementation of foreign experience. In this sense, the study has been planned as theory-applied, containing essential comparative-law elements.
