Settlement of Disputes by Sport Federation on National and International Levels

Almost every sport federation or league, both national and international, has its own system of dispute resolution. The Federations and the League specifically try to limit the involvement of state bodies (primarily courts) in the consideration of disputes that have arisen between its members. The reasons for this are clear: federations and leagues do not want, as they say, to "take out rubbish from their huts" - they value both their reputation and the reputation of their members. But the reason, called federations and leagues themselves, for which sports disputes should not, in their opinion, be considered in state courts, is that sport has specificity, and therefore judges will not be competent in dealing with such cases. The problem of this study is that the current norms of local acts of sports federations and leagues in the Russian Federation are contrary to federal legislation and, first, deprive athletes of the constitutional right to judicial protection, and secondly, deprive them of the possibility of an objective and comprehensive resolution of the dispute . The purpose of the research: to consider the specifics of the consideration of sports disputes at the level of all-Russian sports federations and leagues, to analyze the analogous experience of international sports organizations, to identify legal conflicts, gaps and problems of regulation in this area and, as a result of theoretical research, to develop proposals for improving the system of consideration of sports disputes in the Russian Federation, using foreign and international experience. The result of this study is the development of a Model Provision on the Resolution of Disputes in a Sports Federation (Annex 1) (hereinafter - the Regulations). This Regulation is proposed for the adoption of each sports federation that deals with the resolution of sports disputes in the Russian Federation.
