The Legal Nature of the Compensation for Termination of Labour Contracts of Sportsmen's Own Free Will

The graduate qualification work consists of an introductory paragraph, 2 chapters, including 5 paragraphs, conclusion and bibliography. The purpose of the graduate qualification work is to study the legal nature, problems and prospects of the legal institute of compensation for early termination of a labour contract by a sportsman without just cause. The objectives of this research are to study the prerequisites and conditions of implementation in the Russian Legislation of referenced hereinabove legal institute, to study the doctrinal positions on the legal nature of the institute, to analyse the law enforcement practice, to consider the experience of foreign law systems and international sports organizations on the issue of the application of the norms of legal institute, to determine the main problems of application of the norm of Russian legal institute for finding the ways of solving it. The first Chapter of the master research deals with the Russian legislative regulation and practice in the application of the institute of the compensation for early termination of a labour contract by a sportsman without just cause. Despite this chapter contains the analysis of the nature of the Russian legal Institute. The second Chapter involves a comparative analysis of the institute in continental law (for example, in Germany, France and Italy) and in the common law (for example, in UK), including the applicable practice of international sports organizations. The following conclusions were made as a result of the master research: 1. The studied institute, both in domestic and foreign legal system, is partially regulated by the norms of civil law. 2. The current reduction of Art. 348 of the Russian Labour Code creates a number of problems regarding the practical application of the studied institute. 3. The remedies have been offered in purpose of solving the problems of application the Russian legal institute.
