Legal Regulation of Labour Relations with Professional Athletes with Disabilities.

Disability has been a social phenomenon for a long time and it’s important for each state in accordance with its possibilities and priorities to form their own social and legal policy in relation to people with disabilities, namely, according such category of workers as professional athletes. In this connection the aim of current research is to make an effort to identify the features for labour relations, which come from the fact that the athlete with disability refers directly to two categories of workers – sportsmen and disabled worker, and try to find a solution of the problems, that are caused by this fact. Within the framework of this aim the following tasks were set: to identify the impact of adaptive sports on people with disabilities; to characterize the legal status of athletes with disabilities; to explore the procedure for concluding and terminating an employment contract with disabled athletes; to examine the legislation of Russia and foreign countries in the field of physical culture and sports of disabled people. The research allowed to draw the following conclusions. Firstly, the adaptive sport is one of the most effective ways of rehabilitation for disabled people nowadays. As well it was found out, that the employment of athletes with disabilities is specific as they belong to the special category of citizens. Furthermore, we came to the conclusion that when concluding and terminating an employment contract, a disabled sportsman will appear in three statuses: as athlete, as disabled person and as employee. This is reflected in the terms of the employment contract. It was also proposed to consider the possibility of completing and amending chapter 54.1. The Labor Code of the Russian Federation and the Federal Law «On Physical Culture and Sport in the Russian Federation» by general provisions about the regulation of labor relations with disabled athletes, which will allow the development of this direction in sports law at the legislative level.
