In modern society the guarantee and protection of human rights and freedoms are an inalienable elements of a democratic state. One of the fundamental freedoms is the freedom of conscience and religion.

In the paper the decisions of the Constitutional Court of the Russian Federation and the European Court of Human Rights on freedom of religion was considered, as well as their specific features. In addition, the author analyzed the practice for the application of legislation and assessed the religion situation in Russia.

The research revealed problems of legislative regulation of freedom of conscience, discrimination against non-traditional religions, which are the consequences of unformed feelings of religious tolerance and religious pluralism.

Student Theses at HSE must be completed in accordance with the University Rules and regulations specified by each educational programme.
