Powers of the Prosecutor at Criminal Proceedings

In the conditions of very important role of prosecutor in criminal proceedings it is essential to discuss powers of the prosecutors. They try to confront the growth of crime rate, ensure the rights and freedoms, take measures to prompt and effective investigation of criminal proceedings. The relevance of this Paper is based on the reform of law enforcement system and consequently the reform of prosecutorial system.As a scope of research in the Paper is legal framework and institutional framework govern the activities of bodies of the procuracy to ensure the security of the country. Powers of prosecutor in criminal proceedings, concept and the meaning of criminal prosecution and prosecusional supervision of activities of bodies of inquiry and pre-trial bodies is the main subject matter. Justification of the concept of multifunctional system of activities of prosecutor in criminal proceedings in accordance with prosecutor’s powers is the purpose of the work. To achieve this purpose the Paper sets such aims as to define powers of prosecutor in criminal proceedings, to define functions of prosecutor in criminal proceedings, to identify the specific of prosecutor’s functions in every phase of criminal process, to propose improvement of legislation governing the status and the powers of the prosecutor in criminal proceedings. In response to the questions posed in the Paper, there were reached following conclusions. It was important to approach the activities of prosecutor as multifunctional. New definitions of functions and powers of prosecutor were suggested. The importance of the specific functions of the prosecutor in every phase of criminal proceedings was clarified. Also there is not an exact definition of prosecutor’s status as a participant in the criminal proposal in The Criminal Procedure Code. Analysis of prosecutor’s activities on every phase of criminal proceedings found some problems with gaps in the criminal legislation.
