The Scope of the Pledge in Russian Law

The main purpose of this paper is researching the regulation and problems of the scope of pledge in Russian Civil law. That principle may be defined as spreading of the pledge on physical or money substitutes. On the one hand, it strengthens the security function of the pledge and increases creditors trust. On the other hand, wide interpretation could lead to unjust infringing of pledger or third parties. That is why, researching of spreading of pledge is necessary. This research will be focused on theoretical foundations of that principle, defining the main cases of spreading of the pledge and on analyzing the most difficult cases when spreading of the pledge may infringes interests of third parties. That paper consist from two chapters. In first one, we describe that principle in Russian law, evaluate practice of courts and compare with foreign legislation. In the second one, we analyze such difficult cases as spreading of pledge in physical changes of property and spreading of the pledge on banking accounts. Finally, we draw a conclusion conclude about efficiency and justice of that principle for parties.
