Competence of Bodies for Conflict Resolution in the Field of Sport
Lawyer in the Field of Sport
(Master’s programme)
2018
The final master's qualifying work is devoted to the complex legal analysis of legal aspects of sports conflicts and disputes. The relevance of the chosen topic is due not only to the fact that sports, especially professional sports, cannot function without conflict situations, but also the fact that recently updated the legislative framework governing the resolution of sports conflicts and disputes in Russia – significant amendments were made to the law on physical culture and sports, in particular, a new Chapter 5.1 "Consideration of disputes in professional sports and sports of the highest achievements". Many of its provisions appear to be rather "raw" and contentious, so there is an objective need to study them. In addition, law enforcement practices have not yet been established to resolve sports disputes.

The aim of this study is a comprehensive study of the legal regulation of conflict resolution in sports, identifying topical problems of legal regulation and determining ways to improve legislation in the field under consideration. The article deals with the concept and legal regulation of sports conflicts and sports disputes; describes the types of conflicts in sports activities and ways to resolve them; examines the features and problems of resolving sports disputes in arbitration (arbitration); the existing gaps in the legislative regulation of the resolution of sports conflicts, including at the international level, are identified. Besides, the author raises the most important question of features of pre-judicial settlement of conflicts in sports and possibility of application of foreign experience in this field.
