Norms of morals in the Russian labor law

The present thesis is devoted to the importance of the norms of decency in the area of domestic labor law. The work examines the forms of the influence of morality on the building of the norms of labor law, giving examples of such influence, as well as focuses on the issue of both theoretical problems and practical area of jurisprudence, which affects issues under discussion. Jurisprudence requires strict tools and formulations, which is not typical for morality. At the same time, the implementation of the such legal provisions is necessary in view of the realities of social relations to be addressed. The legislator needs to audit the existing formulations and legal tools of qualification, for instance, law’s abusing, and, where possible, to improve legal technique. Difficulties and problems of dismissal for being intoxicated in the workplace, breaches of professional and corporate ethics and mobbing are considered in detail. As a result of the research, the author proposed several solutions to solve these problems, one of which is the introduction of an additional form of compensation for illegal dismissal.
