«Open Licenses» as a New Form of Disposition of Exclusive Rights

«Open Licenses» is a next stage of development of copyright. Internet, cyberspace, disappearing of tangible things has led to creation of «an infosphere similar to a biological ecosystem in which the laws of informational «biocenosis» as the rules of existence and interaction inside the network environment begin to work» (J. Bruce, 2016). The lack of attention to the creative products, which is caused by information overload is a serious problem of information society. Also, immaterial form of creative products makes prohibitions powerless, because no resources is spent while making copies or distributing creative product in digital environment. All this in total due to the fact, that copyright must be reconsidered, so open licenses is a solution to the challenge of new century. So, researching the legal nature of the Open license is a key to the further development of science and creative work. The main object of this paper work is distinguishing exclusive rights in Russian Federation, which can be alienated according to open license, as well as remedies of the parties appearing while execution conditions of the license. We also examine as a scope of research regulated by the norms of civil law, public relations, emerging in the process of using objects of copyright; system of theoretical representations about licensing of use of objects of copyright.
