Prejudiciality of Judicial Acts in Russian Federation and USA

In modern civil process a significant role played by the judicial acts, whose existence is exempt from re-proving the same facts, the existence of which was proved. In the context of modern science, the institution of prejudgment is particularly interesting, since at the moment there is a problem with the definition of the concept of prejudgment. In Russian science, the notion of prejudgment is indicated in different ways. The aim of the current research is determine the place of rules of prejudgment in the system of civil procedural law. Аnalyzing the history of the development prejudgment rules in the domestic civil process. Clarifying the basic principles of the operation of legal institutions, similar to the rules of prejudgment, in foreign law and order on the example of the US legislation.
