Abuse of Procedural Rights in the Civil Process

The main purpose of this work is a full – fledged analysis of abuse of procedural rights in the civil process, as a negative legal phenomenon. Then study of mechanisms of counteraction to abuses for improvement of functioning of civil process. In this study, the following objectives were set: 1. To study and analyze the theoretical foundations of the institution of abuse of procedural rights. 2. To study and analyze scientific works and judicial practice concerning abuses of procedural rights in civil proceedings. 3. Describe approaches to the definition of "abuse of procedural rights". 4. To analyze the main types of abuse of procedural rights. Consider ways to address abuse. 5. Consider the types of liability provided for in the abuse of procedural rights. 6. To assess the current situation with the phenomenon of abuse of procedural rights in the civil process. 7. To consider possible ideas of innovation or reception in the civil procedural legislation, in order to reduce the level of abuse of procedural rights. This work includes an introduction, the main part in the form of three chapters, conclusion, bibliography. Chapters are called: * The term "abuse of procedural rights in civil process". * Types of abuse of procedural rights. • Counteraction to abuse of procedural rights.
