In this research we consider the change in functions of the category "justice" in the process of modernizing civil legislation in Germany and Russia. The doctrine is used to determine the content of justice and its functions. On the basis of a comparison of the development of doctrine with the characteristics of modernization, conclusions are drawn about changing the functions of justice and the factors of change.
