Exception of Members of Economic Company as a Measure of Responsibility and a Way of Protecting Corporate Rights

Despite the fact that the exclusion of a participant from an economic company in the legal literature is usually called the method of resolving corporate conflicts, in practice there is a more complicated situation. This institution is of a dual nature, so that it can be viewed as a measure of responsibility or as a way of protecting corporate rights. However, this issue has been little studied, and in connection with this, in the use of such a method, various problems arise in practice. To eliminate such gaps in the present work, the goal was to consider the institution of excluding a participant from an economic company from the point of view of its mixed nature, for which the main features and properties of the institute were combined with features peculiar to the measures of responsibility and ways of protecting rights.
