Unfair Competition in the Sphere of Trademarks Usage

In this work the concept, signs, legal nature, forms of unfair competition with use of trademarks are investigated. The theoretical part of the work is devoted to the issues of the correlation between the concepts of "unfair competition", "abuse of law" and "violation of law", as well as the disclosure of common features to be determined when qualifying actions of an economic entity as unfair competition. In practical part, special attention was paid to the forms of unfair competition using trademarks, current examples of the competitor's unfair competitor qualification were analyzed. As a result of the research, the author comes to a conclusion about the mixed legal nature of unfair competition, the "flexibility" of this concept, the urgency of applying and improving the legal regulation of the ban on unfair competition using trademarks in order to develop normal competitive relations in the market economy of the Russian Federation.
